Aus unterschiedlichen Gründen wird auf nationaler politischer Ebene immer wieder gefordert, Richtlinien der Europäischen Union prinzipiell nur (noch) „eins zu eins“ (1:1) umzusetzen. Nicht immer ist klar, welches Politikziel hiermit verfolgt wird und ob dies wirklich mittels einer „1:1-Umsetzung“ besser erreicht werden kann als mit ihrem Gegenstück: dem „Gold Plating“. Der Beitrag geht daher der Frage nach, bei welchen Arten von Richtlinien sich die Wahl zwischen einer „1:1-Umsetzung“ und „Gold Plating“ überhaupt stellen kann und ob es – wenn eine solche Wahl zu treffen ist – greifbare allgemeine rechtliche und/oder (rechts-)politische Gründe für einen Grundsatz prinzipieller „1:1-Umsetzung“ gibt. Oder handelt es sich hierbei nur um ein Schlagwort, auf das die nationalen politischen Akteure dann zurückgreifen, wenn eine „zurückhaltende“ oder sogar kontraproduktive Form der Umsetzung solcher Richtlinien gerechtfertigt werden soll, deren Ziele sich nicht mit der eigenen politischen Agenda decken, ihr sogar widersprechen oder deren Umsetzung jedenfalls als politisch nicht besonders dringlich angesehen wird?

Das HVwR liefert in zwölf Bänden eine gesamthaft-repräsentative, systematische und plurale Darstellung von Stand und Perspektiven des deutschen, europäischen und internationalen Verwaltungsrechts. Mehr als 250 Auorinnen und Autoren aus der Wissenschaft beleuchten die allgemeinen Grundstrukturen, Begriffe, Prinzipien und Institute des Verwaltungsrechts sowohl in ausgewählten Referenzgebieten als auch unter Berücksichtigung ihrer verbund-förmigen Verflechtungen.
In diesem Beitrag geht es um eine Besprechung einer Arbeit von Laura Hering mit dem Titel „Fehlerfolgen im europäischen Eigenverwaltungsrecht – Heilung und Unbeachtlichkeit in rechtsvergleichender Perspektive“, die 2019 erschienen ist. Hierbei handelt es sich um die auf den Stand von Mai 2018 gebrachte Dissertationsschrift Laura Herings, die von Markus Kotzur betreut worden und als Band Nr. 286 in der renommierten Reihe „Beiträge zum ausländi-schen öffentlichen Recht und Völkerrecht“ des Max-Planck-Instituts für öffentliches Recht und Völkerrecht erschienen ist.

Der Band ist Teil der Schriftenreihe des Praxis- und Forschungsnetzwerks der Hochschulen für den öffentlichen Dienst. Das Konzept der besseren Rechtsetzung hat in Wissenschaft und Praxis seit Beginn der 2000er Jahre zunehmend an Bedeutung gewonnen und soll aus unter-schiedlichen Perspektiven sowohl der interdisziplinären Verwaltungsforschung als auch der Vollzugspraxis beleuchtet werden und zur konzeptionellen Weiterentwicklung einer besseren Rechtsetzung beitragen.

Am 23. und 24. September 2021 fanden zum dreizehnten Mal die jährlichen „Speyerer Tage zum Friedhofs- und Bestattungsrecht“ an der Deutschen Universität für Verwaltungswissen-schaften Speyer statt. Hier wurde auch § 8 Abs. 6 BestattG M-V angesprochen, der durch Art. 1 Nr. 5 des Zweiten Gesetzes zur Änderung des Bestattungsgesetzes in das BestattG M-V eingefügt worden ist, am 1. Juni 2022 in Kraft treten soll und eine Qualitätsmanagements-Zertifizierungspflicht für Bestatter einführt. Die Verfassungs- und Unionsrechtskonformität dieser Bestimmung wirft Zweifel auf, denen der Beitrag nachgeht.
Der EuGH hat mittlerweile klargestellt, dass Kapitel III der Richtlinie 2006/123/EG über Dienst-leistungen im Binnenmarkt auch Inlandssachverhalte erfasst. Entsprechendes muss für Art. 59 der Richtlinie 2005/36/EG über die Anerkennung von Berufsqualifikationen und die Richt-linie (EU) 2018/958 über eine Verhältnismäßigkeitsprüfung vor Erlass neuer Berufszulas-sungsvoraussetzungen gelten. Die Abhandlung stellt dar, was dies für bestehende und neu einzuführende nationale Berufszulassungsregelungen bedeutet.
Um EU-Richtlinien, die die Mitgliedstaaten zur Änderung ihres Rechts verpflichten, richtig umzusetzen und das nationale Umsetzungsgesetz richtig auszulegen, ist es unerlässlich, das Ziel jeder einzelnen Richtlinienbestimmung konkret zu bestimmen. Insoweit kann es für den nationalen Rechtsanwender hilfreich sein, auch zu berücksichtigen, welche Auswirkungen die Umsetzung der jeweiligen Richtlinien-Bestimmung auf die Rechtsordnung anderer Mitgliedstaaten hat. Durch einen solchen Rechtsvergleich kann geklärt werden, ob und in welchem Umfang die Richtlinie auch Umsetzungsbedarf in der eigenen Rechtsordnung schafft. Der Beitrag stellt diesen Ansatz vor. Er zeigt am Beispiel des zur Umsetzung der Dienstleistungsrichtlinie in das VwVfG eingeführten § VWVFG § 42 a VwVfG, dass er helfen kann, ungewollte überschießende Richtlinienumsetzungen – auch in Form nicht gebotener „richtlinienkonformer Auslegungen“ – zu vermeiden.

This thesis explores the principles of administrative punishment under the European Con-vention of Human Rights (ECHR). Administrative punishment, for its part, is gaining popularity across European legal systems because it is a flexible, speedy and cost-efficient option. More precisely, it allows public authorities to inflict punishment without having to undergo a judi-cial action. The procedural safeguards that the concerned individual can expect are accor-dingly lower. However, whilst at the national and European Union levels the academic atten-tion grew in line with the gradual expansion of the use of administrative punishment, the same cannot be said regarding the legal framework of the Council of Europe (‘CoE’). Compre-hensive scholarly works on the subject matter are still missing and only a few authors are researching administrative sanctions within this framework more profoundly, i.e., in a cross-cutting manner.
This is regrettable because nowadays, one can speak of a rich and congruent body of admini-strative punishment under the CoE’s law. Not only has the European Court of Human Rights (ECtHR) admitted administrative sanctions within its remit since the famous Engel case in 1976, but it also interprets all relevant terms found in the letter of ECHR such as ‘criminal charge’, ‘penal procedure’, and ‘penalty’ autonomously and in harmony with one another. Autonomous interpretation of these key terms by using Engel criteria means that administra-tive sanctions can, and often are, put under scrutiny (as long as they bear ‘punitive’ and ‘de-terrent’ hallmarks). All in all, the following normative sources can be said to comprise the ius puniendi administrativus within the legal framework of the CoE: First, Article 6 ECHR, which ensures the procedural protection for administrative sanctioning by enshrining the right to a fair trial and its various components, i.e., by laying down a range of participatory and defence rights, as well as the possibility to have access to judicial review and the presumption of inno-cence. Secondly, Article 4 of Protocol No. 7 to the ECHR, which stipulates ne bis in idem prin-ciple precluding double jeopardy. Thirdly, Article 7 ECHR is essential in giving substantive pro-tection to the subject-matter, and lays down the requirement of legality including regulatory quality, non-retroactive application of administrative sanctions, and no punishment without personal liability. Finally, Recommendation No. R (91) 1 of the Committee of Ministers to the Members States on administrative sanctions of 13 February 1991 as a ‘soft’ yet authoritative legal act creates boundaries for acceptable administrative sanctioning. All of these normative sources form the backbone of the research.
This thesis intends to fill the aforementioned academic gap and contribute to the legal scho-larship. It furthermore aspires to be a useful source for practitioners working within the field of public law who are empowered to regulate on or impose administrative sanctions. For this reason, the following research questions are tackled: What is a sanction? What purposes does it serve in a legal system? What is an administrative sanction in particular? What are its role and idiosyncratic features? What aims does it follow? How can it be differentiated from other types of public admonition, i.e., from criminal law measures? How do the CoE and the ECtHR conceptualize an administrative sanction? What guarantees stipulated by the ECHR are applicable to these sanctions? To what extent do they apply? Are there any limitations? If so, then what are the implications thereof on the individual rights? Is the current level of pro-tection in the field of administrative punishment regarding fundamental rights sufficient?
The thesis has furthermore sought to verify the following hypothesis: “The ECtHR acknowled-ges certain minimum requirements stemming from the ECHR from which the administrative authorities imposing a punitive administrative measure upon the individual, cannot deviate”. The hypothesis was drafted similarly to the wording of Article 6 (3) ECHR, which, together with other paragraphs of this Article, enlists fundamental individual guarantees for (any kind of) punishment (“Everyone charged with a criminal offence has the following minimum rights […]”).

Im Rahmen der Veranstaltung referierte Univ.-Prof. Dr. Ulrich Stelkens, der Mitglied des Steering Committees dieses Netzwerks ist, über den Ist-Stand in Deutschland.
The article introduces a research project carried out at the German Research Institute of Public Administration and the German University of Administrative Sciences Speyer. It examines the development, content and effectiveness of the written and unwritten standards of good administration drawn up within the framework of the Council of Europe (CoE).
Anlass des Gutachtens ist ein Beschluss der Bundesfachgruppe Bestatter des Bundes-verbands Holz und Kunststoff „Ja zur Meisterpflicht im Bestattungsgewerbe“ vom 7.5.2019, in dem gefordert wird, das Bestattungsgewerbe „im Zuge der Rückvermeisterungsinitiative des Handwerks“ in die Gruppe der sog. „zulassungspflichtigen Handwerke“ der Anlage A der Handwerksordnung aufzunehmen. Es untersucht verfassungsrechtliche und unions-rechtliche Grenzen eines solchen Regelungsvorhabens auch) unter besonderer Berück-sichtigung der Richtlinie 2006/123/EG über Dienstleistungen im Binnenmarkt (die nach der neueren Rechtsprechung des EuGH auch für Inlandssachverhalte gilt) und der Richtlinie (EU) 2018/958 über eine Verhältnismäßigkeitsprüfung vor Erlass neuer Berufsreglementierungen.
Im Laufe der internationalen Debatte über die Sackgasse der europäischen Rechtsstaatlich-keit, wurden die Fälle Polen und Ungarn häufig zum Vergleich gegenübergestellt. Es über-rascht nicht, dass das Hauptaugenmerk der Rechtsgemeinschaft auf den institutionellen Veränderungen lag, die in beiden Ländern eingeführt wurden. Nicht so viel Mühe wurde aber darauf verwandt, die Gründe für die gegenwärtige Unterstützung populistischer Regimes zu analysieren. Wissenschaftler identifizieren hauptsächlich zwei Gruppen von Faktoren, die den größten Einfluss auf die Entscheidung der Bürger, populistische Kandidaten zu unterstützen, gehabt haben könnten. Die erste Gruppe umfasst soziale und wirtschaftliche Aspekte, während die zweite Gruppe kulturelle Faktoren nennt. Dieser Artikel zielt darauf ab, zu untersuchen, wie wirtschaftliche und kulturelle Entwicklungen zusammenwirken, um Unter-stützung für Populismus in Ungarn und Polen zu generieren. Er geht davon aus, dass Gegen-überstellung von sozioökonomischen Argumenten mit denen kultureller Herkunft eine Quelle vieler fruchtbarer Überlegungen sein kann, von denen einige zu einer angemessenen Antwort auf populistische Politik beitragen sollten.

The Council of Europe (CoE) has a long-standing record of promoting standards of good administration in the European legal space. Today, these standards encapsulate the entire range of general organisational, procedural and substantive legal institutions meant to ensure a democratically legitimised, open and transparent administration respecting the rule of law. Therefore, these standards are about the ‘limiting function’ of administrative law, that is, its function to protect individuals from arbitrary power, to legitimise administrative action and to combat corruption and nepotism and other ‘diseases’ with which even a democratic polity willing to be governed by the rule of law may be infected. These CoE standards can be described as ‘pan-European principles of good administration.
Fachtagung der Vereinigung Deutscher, Italienischer und Französischer Verwaltungsrichter und Verwaltungsrichterinnen (Verdif) über Rechtsstreitigkeiten zwischen juristischen Personen des Öffentlichen Rechts vor dem Verwaltungsgericht.
Auf ihren halbjährlichen Fachtagungen fand sich Verdif dieses Jahr in Speyer ein und beschäftigte sich rechtsvergleichend mit allgemeinen Vorträgen und vergleichenden Fallbeispielen mit den Besonderheiten, die für Rechtsstreitigkeiten zwischen juristischen Personen des öffentlichen Rechts gelten. Univ.-Prof. Dr. Ulrich Stelkens stellte insoweit die deutsche Sichtweise vor.

Proportionality in English Administrative Law: Resistance and Strategy in Relational Dynamics

Proportionality is at the centre of heated debates in English administrative law. It has been adopted for matters pertaining to European law and the European Convention on Human Rights, but its use in other areas parts of English administrative law is highly contentious. While some arguments in favour or against applying proportionality in England are similar to those exchanged in relation to other legal systems (such as tensions between increased objectivity in judicial control over administrative action vs. the desirability of more limited control), other arguments are more specific to English administrative law. To understand the challenges encountered by proportionality in English administrative law, this paper adopts a contextual analysis, putting the emphasis on the relational dynamics framing the interactions between the main actors involved in the proportionality test. Paradoxically, this perspective rehabilitates the analysis of the legal techniques behind transplants such as proportionality: indeed, transplants are vehicles for legal changes in ways that go beyond the circulation of ideas across the world. Instead of being merely superficial and rhetorical, transplants engage deeply with the whole gamut of institutions and actors in a legal system, calling on them to rearticulate their implied and explicit relationships.
Prof. Stelkens, Leiter des Programmbereichs „Europäischer Verwaltungsraum“, stellte die Forschungsausrichtung und die Forschungsfelder des Programmbereichs im Rahmen der von der Bayerischen Staatskanzlei ausgerichteten „EU-Referentenrunde“ der Bayerischen Staatsregierung vor. An diesem regelmäßig stattfindenden, insbesondere der internen Abstimmung dienenden Treffen nahmen rund 30 Ministerialbeamte teil, die in den verschiedenen Staatsministerien mit der Unionsrechtsumsetzung betraut sind.

The book is the result of the symposium that, on 21 and 22 June 2018, accompanied the closure of the «Mutations de l'Action Publique et du Droit Public» Chair of Sciences Po Paris. If was decided to analyse the major developments affecting administrative laws in times of profound transformation of the instruments of public action. The contribution reviews these developments and considers those that are emerging for the future in the light of current tensions and changes, with the hope of identifying some ideas on the future of administrative law that could be useful for academic analysis and beyond, perhaps, for the public debate.
Es wird der Frage nachgegangen ob und wie sich eine rechtswissenschaftliche "Beobachtung" neuerer Entwicklungen des Verwaltungsrechts sinnvoll durchführen lässt.
Die Wirtschaft und Verwaltung (Beilage zum Gewerbearchiv) hat die Vorträge der 8. Speyerer Tage zum Friedhofs- und Bestattungsrecht veröffentlicht. Unter anderem findet sich darin ein Beitrag von Univ.-Prof. Dr. Ulrich Stelkens und Ass. iur. Sanja Nadine von Beauvais zur "Rechtsprechung zum Friedhofs- und Bestattungsrecht: Entwicklungen in 2015 und 2016 und Nachlese zu 2014" (WiVerw 1/2017, 1-27). Weitere Beiträge befassen sich mit dem Ende friedhofsrechtlicher Nutzungsrechte, den Besonderheiten der Sozialbestattung im Saarland, der Umsatzsteuerlichen Behandlung der Leistungen der Friedhofsverwaltung sowie der Bedeutung des Wettbewerbsrechts für Friedhofsverwaltung und Bestattungsunternehmer.
