Die Untersuchung beschäftigt sich mit der Dynamik der europäischen Mehrebenenverflechtung in einem ausgewählten Politikfeld. Bei der Entwicklung der analytischen Kategorien wird auf Elemente des Netzwerkansatzes zurückgegriffen. Im Zentrum der Analyse stehen die Auswirkungen europäischer strukturpolitischer Aktivitäten auf die nationale und die regionale Ebene in Deutschland und vice versa. Dabei geht es um die strukturpolitische Begleitung des wirtschaftlichen Wiederaufbaus in den ostdeutschen Ländern und um den Veränderungsdruck, dem sich die Bund-Länder-Gemeinschaftsaufgabe zur Verbesserung der regionalen Wirtschaftsstruktur durch die europäische Integration ausgesetzt sah und sieht. Für die vergleichende empirische Betrachtung wurden Sachsen und Rheinland-Pfalz als Referenzländer ausgewählt. Die regionalpolitischen Implikationen der europäischen Beihilfenaufsicht werden ebenfalls kritisch gewürdigt.
As the executive director or the Research Institute for Public Administration at the German Post-Graduate School of Administrative Sciences and host of the workshop "Regionalization below State-level in Germany and the United States" I would like to thank the President of the National Academy for Public Administration, R. Scott Fosler, for the fine and intensive cooperation which was the precondition for the good atmosphere and the fruitful scientific exchange during the conference.
I also want to thank the Regional Planning Association Rhein-Neckar, INFOBEST Kehl/Strasbourg and the Badische Stahlwerke AG - as destinations and hosts of our excursions they contributed to very useful insights. Algorithms have a profound and growing influence on our lives, but partially remain a black box to us. Keeping the risks that arise from rule-based and learning systems in check is a challenging task for both: society and the legal system. The essay undertakes the challenge to examine existing and adaptable legal solutions and to complement them with further proposals. It designs a regulatory model in four steps along the time axis: preventive regulation instruments, accompanying risk management, ex post facto protection and the vision of an algorithmic responsibility code. Together, they form a legislative blueprint to further regulate applications of artificial intelligence.
‘Killer Flying Robots Are Here. What Do We Do Now?’, ‘A Military Drone With A Mind Of Its Own Was Used In Combat, U.N. Says’ and ‘Possible First Use of AI-Armed Drones Triggers Alarm Bells’ – these are just some headlines to a report issued by the UN Panel of Experts on Libya. What caught the international attention was the panel’s description of the following scene in Libya’s civil war: ‘[Forces] were […] hunted down and remotely engaged by the un-manned combat aerial vehicles or the lethal autonomous weapons systems such as the STM Kargu-2 […]. The lethal autonomous weapons systems were programmed to attack targets without requiring data connectivity between the operator and the munition: in effect, a true “fire, forget and find” capability.’
However, the disruptive potential of AI is not limited to out-of-control killer drones or the military context in general – nor does it only have a negative potential. AI and its global trade promote international development and technological innovation, thereby improving lives. Therefore, the efforts to build a legal and policy framework to harness AI’s benefits and thwart its dangers is in full swing. States, the European Union, international organizations, NGOs, and scholars alike come up with ways of achieving that end. The approaches to the issue are manifold. However, most focus either on instating rules on the development of AI, for instance, how to ensure AI is built ethically or on its use, ie, banning its use in lethal auto-nomous weapon systems (LAWS). Whereas all these efforts are important, a further layer of protection has not gained much traction: regulating AI’s global trade so that responsible actors can use it to benefit humankind while preventing it from ending up in the hands of irresponsible actors.
The legal instrument to achieve this end is international export control law. It aims to mitiga-te the risks to international peace and security associated with the proliferation of sensitive items to irresponsible actors while avoiding unreasonable restrictions on global trade, eco-nomic development, and technological innovation. However, the international export control law is not yet suited to fulfill its promise regarding AI. The dual use nature of AI poses signifi-cant risks to international peace and security. Nevertheless, only in limited circumstances applies international export control law to the transfer of AI applications and technology, leaving a gap in the international export control framework. Until this gap is closed, inter-national human rights due diligence might provide fallback protection to address the issue
of mitigating the risks associated with the proliferation of dual use AI.
Der Vortrag fand in zwei Teilen statt: Zunächst ging es um "Blockchain Technology in public administration? Regulatory, technological and organizational challenges of decentralized IT-systems" und dann um "Artificial Intelligence and the Law", jeweils mit anschließender Diskussion. Im Anschluss an den Vortrag kam es zu mehreren Gesprächen mit der Gruppe, die sich im Trendseminar mit Regulierungsfragen auseinandersetzte.

Das deutsche Gesundheitswesen setzt mit der elektronischen Gesundheitskarte (eGK) zum Sprung in die technikgestützte Zukunft der Gesundheitsplanung und Gesundheitsversorgung an. Noch sind viele Prozesse zusammenzuführen und Voraussetzungen zu schaffen: ein bun-desweit einheitlicher Arztausweis, das Sperren ungültiger Karten, das Verhindern von Rezept-fälschungen, die zuverlässige Identifizierbarkeit von Patienten in der Arztpraxis, die sichere Kommunikation der Leistungserbringer untereinander über Sektorengrenzen hinweg. Auch die Streitfragen sind noch nicht gelöst, wie z. B. die gesundheitspolitische und wirtschaftliche Zurückhaltung der Ärzteschaft, die berufsrechtlich komplexe Umsetzung sowie die Probleme der Datensicherheit und des Datenschutzes. Die einzelnen Beiträge dieses Sammelbandes greifen die Fragen auf; sie geben konzise politische, technisch versierte, ökonomisch begründete und datenschutzrechtlich vertiefte Antworten.

One of the standard textbooks of German-language evaluation research has undergone a new edition. Since the first edition from 2007, 15 years have passed. In the meantime, a lot has happened with regard to the institutionalisation and professionalisation of evaluation research. With the new edition of the Handbook for Evaluation, students, practitioners and also experienced evaluators receive a significantly expanded and updated version of the classic. The volume documents the steps taken so far in the institutionalisation and professionalisation of evaluation and provides practical advice for conducting evaluations throughout their entire course. Despite some desiderata, the handbook is still the most comprehensive introduction to evaluation research for many practitioners and students in German language. It offers orientation and serves as a reference work even for experienced evaluators. Stockmann’s commitment to the professionalisation and institutionalisation of evaluation has thus created an institution of its own kind in the form of the Handbook, the reception of which will hopefully help to clear up the misunderstandings often found about the status and quality characteristics of evaluations.
