The contribution investigates the impact of COVID-19 on long overdue reforms of German healthcare. The pandemic revealed some major shortcomings in patient care and elicited calls for new legislative solutions, more effective use of resources and a reduction of hospital expenditure.
The proposals discussed here clash with the “stability” which is a major feature of the German legal system.
This chapter focuses on the German reaction to the Covid-19 pandemic, in relation to the employment of both the funds from the NGEU and the internal funds. The Deutscher Auf-bau- und Resilienzplan (DARP) is a national recovery and resilience plan that is undoubtedly small, as it uses few resources when compared to the rest of Europe. Nevertheless, Germany has undergone a Copernican revolution both in its domestic economic policies, in which an investment package has been approved that violates the balanced budget, and in its relation-ship with European policies, which have seen resources injected to achieve ambitious reform goals.
Der Vortrag geht auf die Grundlagen und zentralen Anwendungen der "E-Gesetzgebung" ein. Im Mittelpunkt der Präsentation steht die Vorstellung des Moduls "Evaluierung", das ein Bestandteil der elektronischen Gesetzesfolgenabschätzung ist, sowie erster Vorschläge zu einer Weiterentwicklung. Mit diesem Modul können Rechtsetzungsreferentinnen und -referenten die sich aus § 44 Abs. 7 GGO ergebende Prüfanforderung erfüllen.
Der Vortrag geht auf die Grundlagen und zentralen Anwendungen der "E-Gesetzgebung" ein. Im Mittelpunkt der Präsentation steht die Vorstellung des Moduls "Evaluierung", das ein Bestandteil der elektronischen Gesetzesfolgenabschätzung ist. This contribution investigates the German response to the COVID-19 pandemic. The analysis highlights the measures taken by the German government in cooperation with subnational units to mitigate the spread of infections, as well as the efforts made to stem the economic consequences of the containment measures. The emergency situation turned out to be a real stress test for the German legal system, and a serious challenge for democratic institutions
Il saggio analizza le procedure di selezione utilizzate nell’ordinamento italiano e in quello tedesco, sia nell’ambito dell’accesso al pubblico impiego sia rispetto alle progressioni di carriera. L’analisi comparativa si propone di verificare se le procedure impiegate in Germania per garantire l’affermazione del «principio della selezione dei migliori», le promozioni attuate prevalentemente attingendo al personale interno e il sistema di «federalismo competitivo» rappresentino un modello da imitare, suscettibile di essere traslato nella realtà italiana. Proprio le apparenti distanze fra i due ordinamenti suggeriscono l’opportunità di descriverne e compararne le caratteristiche attraverso la scelta di «coppie dicotomiche», volte a stabilire se i contrasti immanenti alle procedure di selezione siano reali o apparenti oppure se si tratti piuttosto di percorsi diversi, orientati nella stessa direzione.

Der Beitrag beruht auf dem Rechtsgutachten "Positive Maßnahmen für mehr Vielfalt in der öffentlichen Verwaltung", das die Autorinnen im Auftrag der Friedrich-Ebert-Stiftung erstellt haben. Er fasst die wichtigsten Punkte knapp zusammen und gibt einen kurzen Überblick über die Zulässigkeit positiver Maßnahmen.
Der zweite Teil des Beitrags enthält die Fortsetzung der Begutachtung des Anspruchs auf Qualifizierung, Überlegungen zu Arbeitsplatzbedingungen in einer digitalisierten Arbeitswelt sowie zur Arbeitsplatzsicherung in der digitalen Transformation und abschließend eine Gesamtbetrachtung und Empfehlungen
Two different States licensed exports of intrusion tools and related items to a third State. That State then used it to spy on human rights defenders, lawyers, journalists, activists, opposition politicians, and dissidents. While one of the licensing States is a member of the Wassenaar Arrangement, the other is not but had declared to follow it unilaterally. The legal analysis considers the attribution of the relevant acts and omissions by the States and examines possible breaches of international export control law and international human rights law.
Das Kapitel befasst sich mit den Beschäftigungsverhältnissen in der Wissenschaft, insbe-sondere an Hochschulen. Sie sind im Grunde auf andere Forschungseinrichtungen über-tragbar. Hauptaugenmerk liegt auf dem Arbeitsrecht. Da an Hochschulen jedoch nicht nur Arbeitnehmer*innen tätig sind, soll auch ein kurzer Blick auf andere Beschäftigungsver-hältnisse geworfen werden. Dazu gehören insbesondere die Beamtenverhältnisse, in denen viele Professor*innen beschäftigt sind.
Das Gutachten untersucht die rechtliche Zulässigkeit von positiven Maßnahmen zur inter-kulturellen Öffnung der öffentlichen Verwaltung. Zwar haben rund 25 Prozent der Bevölke-rung einen sogenannten Migrationshintergrund. In der öffentlichen Verwaltung bildet sich unter den Beschäftigten die Vielfalt der Gesellschaft jedoch nur unzureichend ab. Positive Maßnahmen, die deutsche Übersetzung des englischen Begriffs „affirmative actions“, können dazu dienen dieses Ungleichgewicht abzubauen.
Das Gutachten stellt zunächst den Rechtsrahmen für solche Maßnahmen dar und ordnet an-schließend konkrete Maßnahmen in diesen ein. Schließlich werden konkrete Empfehlungen unterbreitet.
To contribute to the laudable objectives regarding Export Controls the EU – US Trade and Technology Council has set, a multi-disciplinary network of independent experts from research institutes, think tanks, and policy advisory bodies, has joined forces and drafted the following priorities for action.
A further elaboration of the actions recommended below will be performed by the members of this international network in the weeks and months to come, as Working Group 7 of the EU – US Trade and Technology Council will proceed in its work.
Der moderne Krieg verwandelt sich mehr und mehr zu einem digitalen Schlachtfeld: Die Innovationen reichen von autonomen Waffensystemen über digitale Kommandostrukturen bis hin zu Cyberwaffen. Die zunehmende Vernetzung von Militärtechnologien sowie ihr höhe-res Maß an Autonomie gehen Hand in Hand mit einem erhöhten Risiko für internationalen Frieden und Sicherheit. Oft können diese Technologien als sog. Dual Use Güter aber auch zivil genutzt und global gehandelt werden. Sie bergen neben Risiken also ebenfalls ein Potenzial für die internationale wirtschaftliche Entwicklung. Wie aber lässt sich verhindern, dass digitale Dual-Use Güter in die falschen Hände geraten, wie z. B. an diktatorische Regime oder Terroristen? Und ist es möglich, dabei einen fairen Ausgleich zwischen internationaler Sicherheit und internationaler Entwicklung herzustellen?
‘Killer Flying Robots Are Here. What Do We Do Now?’, ‘A Military Drone With A Mind Of Its Own Was Used In Combat, U.N. Says’ and ‘Possible First Use of AI-Armed Drones Triggers Alarm Bells’ – these are just some headlines to a report issued by the UN Panel of Experts on Libya. What caught the international attention was the panel’s description of the following scene in Libya’s civil war: ‘[Forces] were […] hunted down and remotely engaged by the un-manned combat aerial vehicles or the lethal autonomous weapons systems such as the STM Kargu-2 […]. The lethal autonomous weapons systems were programmed to attack targets without requiring data connectivity between the operator and the munition: in effect, a true “fire, forget and find” capability.’
However, the disruptive potential of AI is not limited to out-of-control killer drones or the military context in general – nor does it only have a negative potential. AI and its global trade promote international development and technological innovation, thereby improving lives. Therefore, the efforts to build a legal and policy framework to harness AI’s benefits and thwart its dangers is in full swing. States, the European Union, international organizations, NGOs, and scholars alike come up with ways of achieving that end. The approaches to the issue are manifold. However, most focus either on instating rules on the development of AI, for instance, how to ensure AI is built ethically or on its use, ie, banning its use in lethal auto-nomous weapon systems (LAWS). Whereas all these efforts are important, a further layer of protection has not gained much traction: regulating AI’s global trade so that responsible actors can use it to benefit humankind while preventing it from ending up in the hands of irresponsible actors.
The legal instrument to achieve this end is international export control law. It aims to mitiga-te the risks to international peace and security associated with the proliferation of sensitive items to irresponsible actors while avoiding unreasonable restrictions on global trade, eco-nomic development, and technological innovation. However, the international export control law is not yet suited to fulfill its promise regarding AI. The dual use nature of AI poses signifi-cant risks to international peace and security. Nevertheless, only in limited circumstances applies international export control law to the transfer of AI applications and technology, leaving a gap in the international export control framework. Until this gap is closed, inter-national human rights due diligence might provide fallback protection to address the issue
of mitigating the risks associated with the proliferation of dual use AI.
Whether sovereign rights under the Convention on the Continental Shelf and the Convention on the Territorial Sea and the Contiguous Zone were conferred on the nation state or the nation’s constituent states.
Whether the states of a federation had international personality, or only the federation itself.
Whether a person who worked as an ‘expert on mission’ for the United Nations outside his home state was acting as an ‘official’ for the United Nations within the meaning of the Convention on the Privileges and Immunities of the United Nations and was, therefore, exempt from taxation by his home state.
Im Rahmen des Vortrags wird die Entwicklung der Besseren Rechtsetzung auf Bundesebene skizziert. Ein besonderer Fokus wird dabei auf die Ausgestaltung der Gesetzesfolgenab-schätzung gelegt. Neben der thematischen Ausdifferenzierung wird auch die Digitalisierung des Instruments im Rahmen des Projektes "E-Gesetzgebung" in den Blick genommen.
Organisation und Zuständigkeiten im Bereich der Luftsicherheit sind in Deutschland frag-mentiert. Um Vorschläge für eine mögliche Reform der Organisation und Aufgabenwahr-nehmung zu erarbeiten, wurde das derzeitige System der Luftsicherheit unter besonderer Berücksichtigung der Passagier- und Gepäckkontrollen umfassend untersucht. Hierzu wurde der Ist-Zustand erfasst und mit der Situation in anderen Ländern verglichen. Bei der Unter-suchung wurden die Perspektiven aller relevanten Akteure aus dem Bereich der Luftsicher-heit berücksichtigt (z. B. Luftsicherheitsbehörden, Flughafenbetreiber, Fluggesellschaften, Luftsicherheitsunternehmen). Auf Grundlage dieser Ergebnisse erfolgte die Entwicklung von möglichen Reformvorschlägen.
Digital technologies often have a dual-use nature, which means they can be used for both civil and military purposes. For instance, object recognition software can be used for auto-nomous civil driving or for autonomous targeting within armed drones. Thus, their uncon-trolled proliferation may pose risks to international peace and security. Generally, export controls aim to mitigate these risks while avoiding unreasonable restrictions on global trade and development. The novelty of digital dual-use items and the dynamics of their transfer pose new challenges for the international export control system and raise critical legal questions under international law. Does international law hold export control rules that sufficiently address the broad spectrum of relevant digital dual-use items and their rapid technological advancement? Furthermore, how do these rules treat the digital transfer of such items?
The presentation aims to answer these questions by, first, carving out the relevant inter-national export control rules. Secondly, the application of these rules to the digital dual-use items and their international transfer is analyzed. Finally, to the extent that the applicability is affirmed, the presentation will examine the international export control law’s requirements to the international transfer of digital dual-use items.
For centuries, export control regulations have accompanied the development of new weapon technologies. The revelations of the ‘Pegasus Project’ have put the question of whether and how to regulate the export of the new technology ‘cyberweapons’ in the limelight: Is the current international export control law up to the challenge of sufficiently regulating the proliferation of ‘cyberweapons’ or does it need an update? To answer this question, the blog post will, first, turn to the definition and relevance of ‘cyberweapons’. Secondly, international export control law is introduced as a possible measure to mitigate the risks posed by ‘cyberweapons’ against the backdrop of regulating the use of ‘cyberweapons’ or establishing a moratorium on its trade. Third, the blog post will assess the export of ‘cyberweapons’ in general and the export of Pegasus in particular within the current international export control framework. The current framework seems to touch upon partial aspects of the trade with ‘cyberweapons’. However, it stands to fear that it is not up to the task of sufficiently curtailing the proliferation of ‘cyberweapons’ and the associated risks, as it especially leaves the underlying problem of the trade with zero-day vulnerabilities untouched.
La crisi legata alla diffusione globale del virus SARS-Covid 19, dopo aver imposto agli Stati europei di impiegare strumenti emergenziali per rispondere alla prima fase della pandemia, sta ora richiedendo l’adozione di riforme amministrative strutturali che possano permettere l’effettiva realizzazione dei progetti contenuti nei Piani Nazionali di Ripresa e Resilienza e finanziati attraverso il Recovery fund europeo.
I sistemi amministrativi nazionali si trovano, quindi, di fronte ad una nuova fase di profondo mutamento nella cornice delineata dalle istituzioni europee e dovranno affrontare nei prossimi anni trasformazioni necessarie per permettere la ripresa del sistema economico.
L’analisi dei diversi Piani di ripresa mostra come i diversi Paesi abbiano previsto interventi e azioni solo in parte simili. In alcuni casi, le riforme previste rappresentano la realizzazione di progetti già in corso, avviati durante il 2020 oppure già in fase di realizzazione. In altri casi, invece, si tratta di riforme del tutto nuove che sono state previste per la prima volta.
Handbuch Onlinezugangsgesetz

Das Handbuch arbeitet die Anforderungen und Konsequenzen des Gesetzes zur Verbes-serung des Onlinezugangs zu Verwaltungsleistungen (Onlinezugangsgesetz - OZG) vom 14.08.2017 auf. Das OZG bildet nach den Vorstellungen von Bund und Ländern die entschei-dende rechtliche Grundlage für eine umfassende und weitreichende Digitalisierungs-initiative im Bereich der öffentlichen Verwaltung. Bund und Länder sind auf Basis des OZG verpflichtet, bis zum Jahr 2022 ihre Verwaltungsportale zu einem Portalverbund zu ver-knüpfen und alle rechtlich und tatsächlich geeigneten Dienstleistungen darüber auch online anzubieten. Diese Bestimmungen enthalten große Sprengkraft.
Nach einer Kartierung der rechtlichen Anforderungen und Möglichkeiten im ersten Teil des Buches werden im zweiten Teil die Potenziale und Grenzen der Verwaltungsautomation aus Sicht der Verwaltungsinformatik als dem "Maschinenraum der Verwaltung" aufgezeigt. Im dritten Teil werden die organisatorischen bzw. institutionellen Gestaltungspotenziale näher untersucht. Der vierte Teil widmet sich den neuen Anforderungen an Führung und Ethik im öffentlichen Dienst.
Academic freedom is currently under pressure. The most obvious cases in Europe are those of Hungary and Poland, where the state interferes directly in core academic issues by chan-ging the laws. More generally, research and teaching are at risk in European democracies. Except in Hungary and Poland, this is not only due to political constraints: society itself seems to have lost its trust in science. Scientific results are declared “fake news” and students and lecturers are not allowed to discuss social, gender or integration issues (keyword: “trigger warning”). Such threats to research and teaching curb scientific autonomy directly and indirectly.
Universities in Germany and other countries have recently undergone comprehensive reforms: they are expected to contribute to social development through exchange with external actors. These exchanges are commonly termed “third mission”. In this context knowledge and technology transfer can prove to be particularly critical to academic freedom, because market logic and economically rational behaviour may lead to goals in conflict with the institutional logic of scientific communities.
Is academic freedom threatened? The book examines current challenges to academic freedom in Europe, focusing mainly on Italy and Germany.
The cases discussed demonstrate that research and teaching are under pressure in Euro-pean democracies: in Hungary and Poland due to political constraints, in other countries due to societal expectations. Considering different interrelated aspects, the four parts of the book explore many real and potential threats to universities, scientific institutions and researchers, ranging from the European dimension of freedom of the arts and sciences to comparative analysis of emerging challenges to academic freedom against the backdrop of the COVID-19 pandemic. They highlight threats to university autonomy from the economic orientation of university governance, which emphasizes efficiency, competition, and external evaluation, and from new rules concerning trigger warnings, speech restrictions, and ethics commissions.
Detailed study of these complex threats is intended to stimulate scholarly reflection and elicit serious discussion at European and national level. The volume contributes to the search for a new role of universities and scientific institutions and is addressed to academics and political stakeholders.
The essay examines changes in German law on administrative procedure recently introduced to address the challenge of digitization. This reform was undertaken in the framework of the very complex German legal system, which has federal structure, as well as the so-called “three pillars” of general administrative, financial and social security procedures, and a tradition of homogeneous development. The article also investigates the links between administrative procedural law and the legislation on e-government, as well as the problem of the poor interoperability of the IT systems of the various levels of government (Federation, Länder and Municipalities), that the (federal) law on online access to public services proposes to solve. Finally, the potential and limits of digitization of administrative procedure are examined, distinguishing binding and routine measures (easily automated) from the new frontiers of artificial intelligence.
It has long been a commonplace that the European Union forms a community of law and that the principle of “integration through law” is one of its central characteristics. In view of the growing scope and complexity of Union law, which requires ever new adaptations from the Member States, research on the implementation of Union law, which also works empiri-cally, is gaining considerable importance. An international research project conducted at the German Research Institute for Public Administration was dedicated to the implementation and adaptation strategies of selected EU Member States. It investigated the transposition of organisational and procedural requirements for national administrations as laid down in EU directives related to environmental and energy policy. The investigation focused on various modalities of transposition: minimum transposition (“copy out”), the enactment of provisions that create obligations going beyond the requirements of the Directive (“gold-plating”) and the extension of the rules or principles of the Directive to other fields of law (“spill-over”), either by including a subject area not provided for in the Directive in the scope of application of the transposition provisions (spill-over in the narrow sense) or by fundamentally reforming a legal area on the occasion of the Directive (spill-over in the broad sense). The comparative analysis revealed a low degree of strategic use of transposition modalities. However, there is a growing awareness among Member States that they belong not only to a law community, but also to an implementation community. This is not least due to the mechanisms and procedures of intertwining Union and national action.

La Resilienza ai Cambiamenti Climatici Nella Gestione Del Territorio: Uno Sguardo al Sistema Tedesco

Il saggio pone in risalto le misure adottate in Germania nell’ambito della strategia di prevenzione di eventi calamitosi legati ai fattori climatici. L’analisi illustra le modifiche introdotte nella legislazione urbanistica allo scopo di contrastare i cambiamenti climaticie, viceversa, migliorare la resilienza a tale fenomeno.
Mit dem E-Government-Gesetz (EGovG BW) schuf das Land Baden-Württemberg im Jahr 2015 die gesetzliche Grundlage für die Förderung der elektronischen Verwaltung in den Behörden des Landes, den Gemeinden und Gemeindeverbänden sowie den sonstigen der Aufsicht des Landes unterstehenden juristischen Personen des öffentlichen Rechts (Behörden im Sinne des EGovG). Das Gesetz sieht eine Evaluation innerhalb von fünf Jahren nach Inkrafttreten vor; der vorliegende Bericht stellt die Ergebnisse dieser Evaluation dar. Dabei wurden drei Schwerpunkte untersucht: die Wirkung der Handlungspflichten des EGovG BW, die Erfahrun-gen mit der durch das EGovG BW geschaffenen Organisationsstruktur und die Erfahrungen von Bund und Ländern mit deren jeweiligen E-Government-Gesetzen.
Seit seiner Einführung im Jahre 1970 erweist sich in Italien das abrogative Referendum als starker Reformmotor. Insbesondere nach der Schmiergeldaffäre (Tangentopoli) in den 1990er Jahren wurde in großem Ausmaß auf dieses direktdemokratische Instrument u.a. hinsichtlich des Parlamentswahlrechts zurückgegriffen. Anschließend sank nach einer Phase der intensiven Nutzung mit zunehmender Häufigkeit und Zahl von Abstimmungsvorlagen die Beteiligung, was die meisten Volksabstimmungen zum Scheitern verurteilte.
Parallel zu dieser Entwicklung hat der Verfassungsgerichtshof in ständiger Rechtsprechung eine proaktive Rolle eingenommen und ungeschriebene Regeln für die Zulässigkeit von Referenden festgelegt. Insbesondere beim abrogativen Referendum über Wahlgesetze hat sich der italienische Verfassungsgerichtshof (Corte Costituzionale) – zuletzt Anfang 2020 – entschieden gegen die Nutzung dieses direktdemokratischen Instruments zur Manipulierung von Wahlgesetzen ausgesprochen.
Artificial Intelligence (“AI”) is already being employed to make critical legal decisions in many countries all over the world. The use of AI in decision-making is a widely debated issue due to allegations of bias, opacity, and lack of accountability. For many, algorithmic decision-making seems obscure, inscrutable, or virtually dystopic. Like in Kafka’s The Trial, the decision-makers are anonymous and cannot be challenged in a discursive manner. This article addresses the question of how AI technology can be used for legal decisionmaking and decision-support without appearing Kafkaesque.
First, two types of machine learning algorithms are outlined: both Decision Trees and Artificial Neural Networks are commonly used in decision-making software. The real-world use of those technologies is shown on a few examples. Three types of use-cases are identified, depending on how directly humans are influenced by the decision. To establish criteria for evaluating the use of AI in decision-making, machine ethics, the theory of procedural justice, the rule of law, and the principles of due process are consulted. Subsequently, transparency, fairness, accountability, the right to be heard and the right to notice, as well as dignity and respect are discussed. Furthermore, possible safeguards and potential solutions to tackle existing problems are presented. In conclusion, AI rendering decisions on humans does not have to be Kafkaesque. Many solutions and approaches offer possibilities to not only ameliorate the downsides of current AI technologies, but to enrich and enhance the legal system.
The article analyses the fully digitalized administrative procedures introduced by the reform of the General Administrative Procedures Act (Verwaltungsverfahrensgesetz – VwVfG) of 2017. This act is not an all-encompassing codification since the presence of several administrative procedures in the German legal system is dependent upon two factors: Germany’s federal structure, and its so-called "three columns system" comprising the General Administrative Procedures Act, tax procedure law and social law.
However, the legislator is committed to ensuring the uniformity of administrative procedure rules in every code in order to make their interpretation and use easier for administrations and judges. Following changes in tax law, a generalized introduction of robotic measures generated by algorithms was inaugurated in 2017, as it had become clear that mass procedures in tax law administration were particularly suitable for digitization.
This contribution focuses on the analysis of the strategies adopted in Germany against the COVID-19 pandemic. The analysis is divided into two main issues represented by the virological containment of the pandemic on the one hand, and by the effort to stem the economic consequences of the containment measures on the other. This emergency has shown to be a real stress test for Germany, putting a strain on the federal division of competences, the democratic institutions as well as the protection of fundamental rights as a qualifying element of the rule of law.
La gestione dell’emergenza pandemica in Germania è una sfida che mette alla prova il sistema democratico e federale, rivelandone i punti di forza e di debolezza.
Nel complesso, la risposta tedesca all’emergenza è stata gestita secondo i principi dello Stato di diritto e nel rispetto delle dinamiche del federalismo, con una pari attenzione sia alla prevenzione della diffusione del virus, sia ai danni al sistema economico dovuti alle misure anticontagio, accompagnando da subito le restrizioni a misure di sostegno. Il governo federale ha svolto un ruolo di coordinamento politico, rispettando il riparto delle costituzionale delle competenze legislative e amministrative, che vede i Länder protagonisti della gestione in concreto dell’emergenza sanitaria.
Le pesanti limitazioni dei diritti fondamentali dovute alle misure di contrasto hanno sollevato un acceso dibattito e sono state oggetto di un attento controllo giurisdizionale.
Verfolgen die Mitgliedstaaten der Europäischen Union bei der Umsetzung des Unionsrechts unterschiedliche Anpassungsstrategien oder lassen sich die jeweiligen Regelungen zur Umsetzung eher situativ deuten? Der vorliegende Band untersucht in einem ersten Teil, welche Veränderungen in der Verwaltungsorganisation und dem Verwaltungsverfahren die Umsetzung von Richtlinien aus dem Bereich des Umweltschutzes in ausgewählten EU-Mitgliedstaaten bewirkt hat. Der zweite Teil befasst sich daran anknüpfend speziell mit der Transformationswirkung von Richtlinien auf die nationale Regulierungsverwaltung im Energiesektor. Der Band versteht sich als ein Beitrag zur EU-Implementationsforschung.
In Deutschland existieren auf Bundesebene mit dem Bundesamt für Verfassungsschutz (BfV), dem Bundesnachrichtendienst (BND) sowie dem Bundesamt für den Militärischen Abschirm-dienst (BAMAD) drei Nachrichtendienste, deren Hauptaufgabe in der Sammlung und Auswertung von Informationen besteht. Das Nachrichtendienstrecht wurde im Laufe der Jahrzehnte immer weiter kodifiziert. Das erste Gesetz zum Verfassungsschutz erließ das Parlament im Jahre 1950. Die knapp gefassten fünf Paragrafen wurden den Anforderungen an das Recht auf informationelle Selbstbestimmung, wie es das Bundesverfassungsgericht (BVerfG) im Jahre 1983 bestimmt hatte, nicht mehr gerecht. Im Jahre 1990 erfolgten daher eine Novellierung sowie die erste parlamentsgesetzliche Regelung für den MAD und den BND. Durch die Anschläge des 11. September 2001 entstand eine neue Sicherheitslage, die den Deutschen Bundestag seitdem zu insgesamt drei großen Novellierungen des Rechts der Nachrichtendienste in den Jahren 2002, 2007 und 2011 veranlasste.
Während sich das sog. erste Anti-Terrorpaket der straf-und vereinsrechtlichen Bekämpfung des Terrorismus widmete, enthielt das zweite Anti-Terrorpaket das Terrorismus-bekämpfungsgesetz (im Folgenden kurz: TBG; beide 2002). Im Jahre 2007 erfolgte eine Erweiterung der Bestimmungen zur Bekämpfung des Terrorismus mit dem sog. Terrorismus-bekämpfungsergänzungsgesetz (im Folgenden kurz: TBEG). Eine weitere Novellierung nahm der Gesetzgeber im Jahre 2011 mit dem Gesetz zur Änderung des Bundesverfassungsschutz-gesetzes vor (im Folgenden kurz: Änderungsgesetz).
Die mit dem TBG geänderten Bestimmungen im Bundesverfassungsschutzgesetz (BVerfSchG), MAD-Gesetz (MADG), BND-Gesetz (BNDG) und Sicherheitsüberprüfungsgesetz (SÜG) waren zunächst bis zum 10. Januar 2007 befristet, während das TBEG die einheitliche Befristung aufhob und im Einzelnen diejenigen Normen benannte, die einer Verlängerung unterlagen. Insoweit verlängerte sich die Befristung auf den 9. Januar 2012. Das Änderungs-gesetz aus dem Jahr 2011 verlängerte die Geltungsdauer der Regelungen bis zum 9. Januar 2016. Auf Grundlage der im April 2015 abgeschlossenen Evaluation wurde am 3. Dezember 2015 das Gesetz zur Verlängerung der Befristung von Vorschriften nach den Terrorismus-bekämpfungsgesetzen, das eine erneute Befristung und Evaluation der Befugnisse zur Auskunftseinholung bei u. a. Luftfahrtunternehmen, Kreditinstituten, Telekommunikations-diensten und Telediensten sowie der Vorschriften zur Einführung des vorbeugenden personellen Sabotageschutzes vorsah, vom Deutschen Bundestag verabschiedet. Sofern der Bundestag diese Bestimmungen nicht verlängert, wird am 10. Januar 2021 die Rechtslage vom 31. Dezember 2001 wiederhergestellt.

Die öffentliche Verwaltung tritt in Evaluationsprozessen als Auftraggeberin, durchführende Instanz, Informationsquelle und/oder als Evaluationsgegenstand auf. Sie ist dabei durch ihre spezifischen Rationalitäten und Kommunikationsweisen geprägt, die häufig mit denen einer wissenschaftlich fundierten Evaluationsforschung kollidieren. So kommt es immer wieder zu Missverständnissen durch eine verzerrte Wahrnehmung und Kommunikation von Evaluationsergebnissen.
Der Vortrag in der Session des Arbeitskreises Verwaltung beschäftigt sich mit den besonderen Herausforderungen bei der Kommunikation zwischen der Ministerialverwaltung und Evaluatorinnen im Prozess der Gesetzesevaluation. Dabei werden auch mögliche Ansätze zur Verbesserung der Kommunikationsprozesse in den verschiedenen Phasen der Gesetzesevaluation vorgestellt.

Elektronische Gesetzgebung bezeichnet ein durchgängig elektronisches Verfahren vom Textentwurf bis zur Verkündung eines Gesetzes, das Format- und Medienbrüche vermeiden und sowohl den Aufwand als auch die Fehleranfälligkeit einzelner Prozessschritte verringern soll. Sie kann – abhängig von ihrer konkreten Ausgestaltung und ihrer Akzeptanz durch die am Verfahren beteiligten Akteure – zu einer Verbesserung der Qualität der Gesetzgebung beitragen.
Univ.-Prof. Dr. M. Martini widmet sich den übergreifenden Herausforderungen, denen sich Verwaltung und Justiz zu stellen haben, aus einer eher strukturell-analytischen Perspektive. Er leuchtet insbesondere die rechtsstaatlichen und demokratietheoretischen Problemfelder aus, die sich mit dem Einsatz automatisierter und entscheidungsunterstützender Systeme verknüpfen.
Die Bundesregierung erwägt, – ähnlich wie in Österreich – ein nationales Bildungsregister zu etablieren. Der Vortrag erläutert die kompetenziellen und datenschutzrechtlichen Hürden, denen ein solches Vorhaben sich ausgesetzt sieht. Der Vortrag fasst die Ergebnisse eines Gutachtens zusammen, das der Referent im Auftrag des Bundesministeriums für Bildung und Forschung jüngst erstellt hat.

Der Wortlaut von Gesetzestexten wird häufig in Bescheide und andere Schriftstücke der öffentlichen Verwaltung übernommen, ohne den Kontext der zitierten Passagen zu berücksichtigen. Dadurch entstehen unklare Bezüge, die zu Nicht-Verstehbarkeit führen können. Bei der Redaktion von Gesetzestexten sollte daher verstärkt auf einen einfachen Satzbau und gute Verstehbarkeit geachtet werden.
With Britain’s decision to leave the European Union, the question of the lasting legacy of a specific English administrative culture in the remaining member states arises. Although often treated as an import from the United States, this article argues that the British model of independent regulatory authorities is one of the most formative contributions to a common European administrative culture, forcing other EU member states to rethink fundamental ideas of democratic legitimacy. Taking national regulatory authorities in the energy sector as an example, this contribution shows how British approaches towards organisation and independence of these authorities played a decisive role in the drafting of the relevant EU directives. Consequently, only few changes in UK national legislation where necessary to comply, while in Germany major reforms were due, being the only member state in which no regulatory authority existed in the energy sector prior to the implementation of the EU directives. The analysis of these European requirements, the British influence on them, and the different ways of their implementation in the United Kingdom and Germany are the subject of this article.
Die Forschungsstelle Öffentlicher Dienst am Deutschen Forschungsinstitut für öffentliche Verwaltung (FÖV) und das Bundesministerium des Innern, für Bau und Heimat veranstalteten am 19. Dezember 2018 den Workshop „Öffentlicher Dienst und Rechtsetzung auf EU-Ebene“ in der Bayerischen Vertretung in Berlin. Hintergrund war das große Interesse von Praxis und Wissenschaft an den Einwirkungen des EU-Rechts auf das nationale Dienstrecht, das bei der Auftakttagung der Forschungsstelle Öffentlicher Dienst am 21. und 22. März 2018 in Speyer deutlich geworden war.
Der thematische Einstieg erfolgte über das Einleitungsreferat von Tim Vallée, Forschungs-stelle Öffentlicher Dienst, der verschiedene Einwirkungen des EU-Rechts auf das nationale Dienstrecht skizzierte. So führte er etwa die Regulierung religiöser Symbole am Arbeitsplatz als Diskriminierungsproblem und die Bedeutung des europäischen Urlaubsrechts für den öffentlichen Dienst an. Angestoßen durch insgesamt sechs Impulsreferate diskutierten anschließend namhafte Vertreter aus Wissenschaft und Praxis sowie Verbänden kontrovers verschiedene Aspekte der Auswirkungen von EU-Rechtsakten, Aktivitäten der EU-Kommission und EuGH-Rechtsprechung.
Die wöchentliche Arbeitszeit darf aus Gründen des Gesundheitsschutzes europarechtlich pro Siebentageszeitraum 48 Stunden nicht überschreiten. Dieser Bezugszeitraum kann dabei durch nationales Recht auf bis zu vier oder sogar im – hier einschlägigen – Ausnahmefall auf bis zu sechs Monate ausgedehnt werden. Dabei darf ein solcher Bezugszeitraum mit festen Kalendertagen beginnen und enden (fester Bezugszeitraum), sofern die Regelung Mechanismen vorsieht, die einen Schutz wie ein gleitender Bezugszeitraum gewährleisten. So werden Fälle ausgeschlossen, in denen der Arbeitnehmer etwa durch hohe Arbeitslast in den Monaten vor und nach dem Übergang der Bezugszeiträume für einen (hier:) sechsmonatigen fiktiven Bezugszeitraum keine ausreichenden Ruhezeiten gewährt bekommt. Das deutsche Dienstrecht kennt ebenfalls feste Bezugszeiträume – auf Bundesebene und etwa in Bayern sogar von zwölf Monaten.

Trotz diverser Initiativen und Bemühungen, Verfahren und Prozesse auf den verschiedenen Ebenen des politischen Systems zu digitalisieren, ist zu konstatieren, dass sowohl für den Rechtsetzungsprozess im Allgemeinen als auch für die Gesetzesfolgenabschätzung im Speziellen digitale Unterstützungsangebote weitgehend fehlen. Aus diesem Grund wurde auf Bundesebene im Jahr 2014 im Rahmen des Regierungsprogramms „Digitale Verwaltung 2020“ das Projekt „Elektronisches Gesetzgebungsverfahren“ („E-Gesetzgebung“) ins Leben gerufen. Ziel des Projekts ist es, einen medienbruchfreien elektronischen Workflow zu schaffen und die vorhandenen Arbeitshilfen, Leitfäden und Handbücher zum Rechtsetzungs-verfahren zu konsolidieren und zu digitalisieren. Hierzu gehören auch die Arbeitshilfen zur Gesetzesfolgenabschätzung.
Im Rahmen des Vortrags wurden erste Ergebnisse des Teilprojekts "Konsolidierung und Digitalisierung von Arbeitshilfen, Leitfäden und Handbüchern zum Gesetzgebungsverfahren" vorgestellt. Darüber hinaus wurden die Herausforderungen und Chancen, die sich durch die Digitalisierung der Gesetzesfolgenabschätzung ergeben, thematisiert.
