Es gibt keine allgemein anerkannten, objektiven und operationalen Kriterien, mit deren Hilfe sich abbauwürdige Bürokratieformen im konkreten Fall identifizieren lassen. Hauptgründe hierfür sind die Interessenabhängigkeit von Bürokratiebeurteilungen und die nur als Sum-menwirkung erlebten nachteiligen Folgen von Bürokratie. Daher sollten Kriterien für den Bürokratieabbau konsequent aus der Sicht der Adressaten von Regulierungen und Verwal-tungsmaßnahmen entwickelt werden. Ferner bedürfen die Aufgaben des Bürokratieabbaus und der Deregulierung der gesetzlichen Institutionalisierung in der Bundesregierung und im Deutschen Bundestag. Hierfür kann an die Erfahrungen mit der ehemaligen Projektgruppe Regierungs- und Verwaltungsreform angeknüpft werden, in der die Aufgabe Verwaltungs-reform von 1968 bis 1975 ressortübergreifend auf Bundesebene institutionalisiert war.

The report outlines the basic issues, research questions, approach and methods of the project, the progress made thus far, and the steps to be taken next. Using the approaches and methods of political science and comparative policy research, it consists in a comparative analysis of the implementation and enforcement of national permitting and inspection systems for large industrial installations including Environmental Impact Assessment (EIA), and Major Accident Prevention (MAP). The study is being conducted on a broad selection of EU member states (D, DK, E, F, I, NL, S, UK) using five languages, English, French, German, Italian, and Spanish in all the process of data collection and devising the research instruments.
In the context of growing policy debate on international trends toward environmental integration, such as the EU Directive on IPPC the main objective of the project is to explore and analyse the existence and extent of an integrated approach in the national environmental laws and administrations of member states, the different problems involved in its achievement and practical implementation and enforcement, the factors of various types that account for the similarities and variation identified in the countries included, and the degree of adaptation of the national systems necessary to meet the requirements of implementation of European legislation.
The report proceeds first by discussing the basic practical and theoretical issues involved in integrated pollution control and permitting. Then, after a comprehensive review of previous research and sources, some conceptual discussion and definitions are presented which, together with the research questions, form the basis of the proposed comparative analytical framework. These lead to the concrete empirical methods proposed in the fourth section. In the fifth section a comparative descriptive overview of the formal legal-administrative aspects of the countries in the study is presented. Finally a description of the steps taken so far and forthcoming steps is found in the last section. Country overviews based on preliminary interviews are attached as Annex I to this report. Annex II contains a list of institutions interviewed. Annex III presents the guidelines for the expert interviews to be conducted in the eight countries.

Die Einführung von Wettbewerb in die über 100 Jahre monopolistisch strukturierte Stromwirtschaft gehört zu den größten Herausforderungen staatlicher Ordnungspolitik. Erste Erfolge sind zwar vorhanden, dennoch existieren noch vielfältige Wettbewerbshindernisse. Die Europäische Kommission hat Anfang 2007 zahlreiche neue regulatorische Maßnahmen angekündigt. Fraglich ist aber, inwieweit das dichte Geflecht aus bestehenden und künftigen Regelungen wirksam vollzogen werden kann. Eines der Hauptprobleme eines wirksamen Vollzugs ist und bleibt die Informationsasymmetrie, deren Beseitigung in der öffentlichen Diskussion eine untergeordnete Rolle spielt.
Sabine Frenzel liefert eine sorgfältige empirische und rechtliche Analyse der bestehenden Wettbewerbshindernisse im Strommarkt und vorhandener regulatorischer Mängel. Sie entwickelt ein EG-rechtskonformes Modell regulierter Selbstregulierung für den Strommarkt, das seine Grundlage in dem verfassungsrechtlichen Konzept der staatlichen Gewährleistungsverantwortung hat. Hierbei zeigt die Autorin auf, dass eine effektive Regulierung gelingen kann, wenn Staat und Gesellschaft zusammenwirken: Der Staat, der den rechtlichen Rahmen für die Erfüllung von Gemeinwohlaufgaben gewährleistet und gesellschaftliche Akteure, die an der Aufgabenerfüllung teilhaben.
The first volume of the new Transatlantic Public Policy Series comprises contributions by members of the Transatlantic Policy Consortium (TPC). Earlier versions of the papers published in this volume have been presented and discussed at the TPC Colloquium in Speyer, Germany, in June 2003 on the theme of Liberalization and Democratic Governance. They centre around subthemes which are critical on both sides of the Atlantic: the role of the state with social and economic actors, policy development and regulatory challenges to the state and the changing nature of democratic institutions and participation. Some contributions represent updated versions of papers originally prepared for the TPC Colloquium in Pittsburgh, Pennsylvania/USA, in September 2001 on public service ethics at both national and international levels. The earlier publication of these papers fell victim to the terrorist attacks of that time. The volume provides a unique insight into European and US-American public policy issues and thinking. Ernst Ulrich von Weizsäcker made a remarkable contribution on "The Old and New Europe: Alternatives for Future Transatlantic Relations?" Three professors based at the German University of Administrative Sciences contributed to this volume: Stefan Fisch ("The 1832 Mass Rally for Democracy in Germany and Europe in Hambach Castle"), Siegfried Magiera ("The Role of Parliaments in the Future Architecture of the European Union"), and Hans Herbert von Arnim ("Institutionalized Political Unaccountability and Political Corruption in Germany").
Der Band dokumentiert eine von der Humboldt-Universität zu Berlin, dem Forschungs-zentrum Umweltrecht (Berlin) und von der Deutschen Hochschule für Verwaltungswissen-schaften Speyer organisierte wissenschaftliche Tagung zum ministeriellen Entwurf eines Umweltgesetzbuchs 2009 (UGB 2009). Mit diesem in der Tradition anderer großer Kodifika-tionen wie dem Bürgerlichen Gesetzbuch oder den Büchern des Sozialgesetzbuchs stehen-den Gesetzbuch sollte das zersplitterte deutsche Umweltrecht jedenfalls teilweise zusam-mengefasst und damit anwenderfreundlicher gestaltet werden. Zwar konnte das UGB in der 16. Legislaturperiode als Gesamtvorhaben politisch wegen des im Frühjahr 2009 aufziehen-den Wahlkampfs nicht mehr realisiert werden. Auf Grund der nach wie vor bestehenden Umweltrechtszersplitterung und der damit einhergehenden Unübersichtlichkeit der Rechts-materie hat das Projekt eines Umweltgesetzbuchs gleichwohl nicht an Aktualität verloren.
Der Tagungsband enthält Beiträge aus Rechtswissenschaft, Verwaltung, Ministerien und Politik. Von den Autoren werden darin die Notwendigkeit einer Kodifikation als Mittel zur guten Gesetzgebung und als Beitrag zur Entbürokratisierung, aber auch politische und verfassungsrechtliche Rahmenbedingungen für eine Umweltrechtskodifikation beleuchtet. Andere Autoren befassen sich mit der während der Entwurfserarbeitung besonders um-strittenen integrierten Vorhabengenehmigung. Daneben werden die besonderen Teile des Entwurfs z. B. über das Wasserrecht und das Naturschutzrecht sowie die Folgen einer Umweltrechtskodifikation für das nicht-kodifizierte Umweltrecht und das Umweltrecht der Länder diskutiert. Zuletzt bietet der Band mit dem Protokoll der abschließenden Podiums-diskussion einen Einblick in die Standpunkte der Industrie- und Umweltverbände zum Projekt eines Umweltgesetzbuchs.
The contributions of this volume are based on the colloquium "Repositioning Europe and America for Growth: The Role of Governments and Private Actors in Key Policy Areas", held by the Transatlantic Policy Consortium. The 16 provocative papers analyze and compare approaches of collaborative governance, co-production, and traditional command and control to current policy issues in key policy areas. The volume provides a unique insight into these problems from a European and US perspective.
