- Gefahr, dass „Rechtsarbeit“ vorzeitig abgebrochen wird, da die „einzig richtige Entscheidung“ nach deutschen Methoden bzw. Anwendungsroutinen schon gefunden scheint
- Gefahr, dass unionsrechtliche Verpflichtungen unter- oder überschätzt werden
- Gefahr der Sinnentleerung unionsrechtlicher Vorgaben durch „buchstabengetreue Verwirklichung“ – mit erheblichen Folgen auf allen drei Stufen des Verwirklichungsprozesses - Notwendigkeit, die mit einer unionsrechtlichen Regelung verfolgten Ziele schon bei der Umsetzung auf der ersten Stufe richtig zu erfassen
- Notwendigkeit, die mit einer unionsrechtlichen Regelung verfolgten Ziele so konsequent zu verwirklichen, wie „selbstbestimmtes“ Politikziel verwirklicht würde … auch wenn dieses Politikziel nicht geteilt oder nicht für dringlich angesehen wird und man mit guter Verwirklichung des Unionsrechts i.d.R. keine Wahlen gewinnen kann
- Streben nach „Minimalverwirklichung“ des Unionsrechts im nationalen Recht durch „1:1 Umsetzung“ geht fast immer schief
